HISTORY
The firm has been in operation since November 1929, when Ben Matz and John Pincus joined forces and began the firm Pincus & Matz. From their Standard Bank Chambers, Main Road, Wynberg, they moved to the Duncan Taylor’s Building on the corner of Maynard and Main Roads in 1935. When JL Feinberg joined as partner in 1944, the firm’s name adapted to Pincus Matz & Feinberg. In 1954, at the request of the then Permanent Building Society, they opened a second office in the Permanent Building, Main Road, Claremont.
In 1986, Pincus Matz & Feinberg and Marquard & Hugo-Hamman amalgamated forming Pincus Matz – Marquard Hugo-Hamman. The name was shortened to Pincus Matz & Marquard in 1997.
Today they operate solely from Pincus Matz House in Brodie Road, Wynberg

FAQ
1. How long will it take?
Failing reaching a settlement through negotiation it may take approximately one and a half years to get a matter to trial.
2. How much will it cost?
This depends on the matter and the time required bringing such to completion, whether by negotiation or litigation. We charge an hourly rate and the longer it takes the more expensive it becomes. A straight forward litigation matter in the Magistrate’s Court may cost in the region of R 50 000 and in the High Court R 150 000, to completion of trial.
3. Will the other party pay my costs if I win?

Estate planning
•An estate plan is essential for each and every client and can be as simple as drawing a will, but may include an
assurance analysis, tax planning and establishment of trusts.
•It is essential to put into place or revise an estate plan when you acquire or sell assets, or when your family circumstances change.
•We assist you in planning your affairs, particularly the structure of asset ownership, to provide for your unique needs, ensuring that your estate is as tax efficient as possible and that the administration of your estate proceeds smoothly.
DRAFTING AND UPDATING WILLS
•Your will is a very personal and extremely important document – it will determine how the property you have accumulated is dealt with when you die.
•It is both advisable and wise to ensure that your will is in line with your estate plan, meets the needs of your family circumstances and is regularly updated to keep abreast of changes in your own circumstances, your family’s circumstances and current legislation.
•The drafting and finalising of this document should be entrusted to professionals. We have the knowledge and expertise to assist you in this regard and to ensure that your will is both valid and enforceable.
WINDING UP OF DECEASED ESTATES
•We provide caring personal attention to your family and the efficient administration of your estate as prescribed by the Administration of Estates Act and the Master of the High Court.
•We have the staff and expertise to deal with disputes and any legal questions which may arise during the process.
•Our aim is to ensure a comfortable and stress free experience in your dealing with this sensitive area of the law.
Interacting with you and your debtors, our approach is at all times based on ethical and effective legal procedures.
We are sensitive to the fact that different claims and debtors require subtly differing approaches.
For instance while we will take every possible lawful action to recover a debt, our experience has taught us that it is often inadvisable to alienate our clients’ debtors who are, after all, their customers and who may, on their rehabilitation, continue to be customers, sometimes even better ones!
On the other hand, some debtors require a far more robust approach and we will not hesitate to act accordingly.
Our collections fees are based on the tariffs laid down by the Magistrate’s Court Act and by our own professional controlling body.
We endeavour to collect, insofar as the Magistrate’s Court Act allows, all the legal costs from the debtors.
Where the Law does not permit the recovery of a cost item, we will attempt to secure payment of that item by way of agreement with the debtor.
In appropriate circumstances and subject to certain formal requirements, to charge our fees on a contingency or “no-win no – pay” basis. Please feel free to approach us to discuss this option.
Your wedding day marks the beginning of your new life together and a coming together of your assets. This has long-lasting consequences on your estate plan and it is vital, therefore, to consult with us on the most suitable marital regime for you. Should you opt to enter into an antenuptial contract, we have our own notary to execute your deed-even if it’s at the last minute!
To complement the service that the Property Department offers, we have our own notary to execute a Notarial deed of Servitude, a Notarial bond, Servitude of Exclusive use areas, and authentication of signatures on documents executed in the Republic for use outside South Africa. This lends towards time-saving and quality of service which are essential for conveyancing and related matters.
We offer assistance with service and filing and Court Appearances and any other task required in the assistance of a matter, including providing a service address within 8 kilometres of the Wynberg Magistrate’s court at a very competitive tariff.
